When To Take Action For Medical Malpractice
We want to trust that doctors are going to do what is the best for our health. But devastatingly, this trust may be broken when a doctor commits an oversight, mistake, or other error. We may have had a feeling that something was not quite right with what the doctor was saying or what they recommended as a treatment plan, but since we are not medical professionals, there’s really not a way to know for sure what’s correct and what’s not. There are warning signs that medical malpractice may have happened to you or someone that you care about. Here we have gone into further detail about what the signs look like, and what your next step should be if you believe this is so.
Your Treatment Is Not Working
If you have followed all of the doctor’s recommendations and taken prescribed medications, underwent surgeries, or otherwise abided by your doctor’s treatment plan and your condition is not getting better, it could be a sign that you were misdiagnosed. Or it could be a sign that your doctor did not provide you with a proper treatment plan from the start. Aside from terminal illnesses, where a care plan is often to provide comfort, a treatment plan should make a patient feel better.
Your Treatment Doesn’t Make Sense
If you were diagnosed with a medical condition that’s not incredibly serious, and your doctor ordered heavy medications or invasive surgeries with severe side-effects, then you may have a case for medical malpractice. And the vice versa is true, if your doctor diagnosed you with a serious illness or disease, and has not recommended aggressive enough treatment, then this may be reason to file a medical malpractice claim as well.
Your Doctor Didn’t Order Diagnostics
Diseases are usually only diagnosed after the patient has had extensive testing done. If you were diagnosed with an illness and did not receive basic lab tests, then you might have been misdiagnosed. Furthermore, if you have a moderate to severe illness and your doctor has failed to recommend anything beyond just basic diagnostics, then it could be a sign that they are not taking your concerns or your health seriously enough, and this can result in a diagnosis and treatment plan that is delayed.
Your Second Opinion Was Different
Many people get a second opinion from another doctor at another medical facility entirely, just to make sure that the first doctor did not miss anything or conclude an incorrect diagnosis. If you did get a second opinion from another doctor and it was much different from what the first doctor had to say, then it’s possible that the first doctor made a mistake. As your lawyer may suggest, similar to a medical malpractice lawyer patients trust at Dave Albo, it may even be a good idea to get a third opinion and then compare all of the conclusions, to determine whether a medical malpractice has happened to you and taking legal action is warranted.
